SÓMA BATHHOUSE TERMS & CONDITIONS

Please read these terms and conditions ("Terms and Conditions", "Terms") carefully before entering and using Sóma Bathhouse ("us", "we", "our") located at 15 Rose St, Essendon, Victoria 3040 ("Bathhouse") and/or using www.somabathhouse.com website (“Site”). The Terms and Conditions apply to use of the Bathhouse and Site.

Conditions of use

By using this Site and entering the Bathhouse, you certify that you have read, reviewed the Terms and agree to comply with the Terms. If you do not agree with the Terms, you must not access the Bathhouse, browse or use this Site. 

We reserve all rights to amend the Terms at our discretion and can do so at any given time.

Each time you use our Bathhouse or our Site, it is your responsibility to ensure that you are aware of our Terms as published from time to time. The Terms, as amended by us from time to time, continue to apply if you use our Bathhouse or browse our Site.

Code of conduct

It’s pretty simple. We have a zero tolerance to any inappropriate behaviour, including but not limited to discrimination, rude remarks or bullying. We absolutely do not allow any illicit substances in the Bathhouse or allow anyone under the influence.

You agree to respect the privacy and peace of the Bathhouse staff (the “Staff) and all other guests at the Bathhouse.
If you breach this clause or in the reasonable opinion of the Staff, you are causing a disturbance or nuisance to other Bathhouse guests or the Staff, you must immediately leave the bathhouse.

Age restriction

You must be at least 17 years of age or over to use the Bathhouse. If you are under the age of 17 years (a “Minor”), you must be accompanied by a guardian at all times. All guardians are required to pay for the Bathhouse entry and are responsible for Minors in their care at all times.

To use the Bathhouse, Minors must be over the age of 15. This is both for the safety of the Children and the patrons enjoying the Bathhouse.

We reserve the right to restrict access and refuse entry to Minors and and minors under the ages of 15 to the Bathhouse.

Pricing

All prices on the site are listed in AUD (unless otherwise specified) and are subject to change without any notice.  

Bookings

All bookings for the Bathhouse will be processed through our Site. You can make Bookings yourself via our Site or come to the Bathhouse in person during our opening hours where a staff member will process your booking on your behalf. All Bookings are subject to availability and the Terms.

You must advise at the time of your Booking if you are suffering from or affected by any medical conditions that might be complicated or exacerbated by your use of the Bathhouse, or which may necessitate increased supervision or a priority medical response, including:

(a)  conditions involving a high fever;

(b)  extreme hypertension;

(c)  malignant tumours or cancerous conditions;

(d)  liver, kidney and circulation disorders;

(e)  conditions presenting the high risk of haemorrhaging;

(f) anaemic conditions;

(g)  heart failure, recent stroke or recent heart attack;

(h)  pregnancy; or

(i) diabetes.

Bookings for Bathhouse access relate to a time period in which you may access the Bathhouse (“Session”).  Unless otherwise advertised, each Session will be for 60 minutes. Time management is your responsibility and needs to be managed in accordance to your session. It is expected you are dressed and out of your session by the time the hour is finished.  

Reschedule / Cancellation Policy

We have a 9hr cancellation policy at Soma Bathhouse. You are free to move your booking around to another day or time prior to 9 hours before your session. A cancellation within 9 hours of your booked session will result in your session being deducted as a “late cancellation”

A “no show” is considered a late cancellation. Your session will be forfeited for not showing up to your session.

Access to rescheduling your appointment is made via your original booking email.

User accounts

As a user of this Site, you will be asked to provide your personal details when booking your Session(s). You are responsible for ensuring the accuracy of this information, and all activities that occur under your account or password. 

If you think there are any possible issues regarding the security of your account on our Site, please email us immediately at  hello@somabathhouse.com so we may address them accordingly. We reserve all rights to terminate or edit accounts at our sole discretion.

Liability

Sóma Bathhouse is not liable for any injury, loss, damage or claim to the individual or personal belongings. It is at your discretion when entering the Bathhouse and what you bring into the Bathhouse with you. 

To the maximum extent permitted by law, we exclude:

(a)  conditions, guarantees or warranties expressed or implied by law; and

(b)  any liability to you or to any third person however arising (and whether arising under statute, negligence or otherwise) for any personal injury or death to you or any third person, or for any special, direct, indirect, or consequential loss or damage arising out of, or in connection with, any person’s access and/or use of the Bathhouse or our Site.

Indemnity 

You agree to indemnify us and our officers, employers or contractors (”Indemnified”) and keep indemnified and hold harmless the Indemnified against from and against any and all actions, claims, demands, losses, damages, taxes, liabilities, costs and/or expenses that may be incurred by, or sustained by, the Indemnified arising out of, or in connection with, your access to, and use of, the Bathhouse, our Site and breach by you of these Terms. This indemnity survives termination of the Terms.
